National Electoral Committee registered 7 candidates for the European Parliament elections after the due date

The National Electoral Committee, proceeding from the ruling of the Supreme Court, reviewed the candidacy documents of the Estonian Greens and registered the 7 candidates to the European Parliament whose security the party had failed to pay in the amount provided in the law. 


The Chairman of the National Electoral Committee Oliver Kask emphasised that although the ruling of the Supreme Court has suspended the decision of the Committee not to register 7 candidates from the Estonian Greens, the requirement to pay the security nevertheless stands. “The Supreme Court only obliged the National Electoral Committee to review its decision regarding the candidates of the Estonian Greens, it did not form a position on the constitutionality of the requirement to pay the security. Parties and independent candidates who receive at least 5% of the valid votes across the country will get their security refunded. The rest must first wait for a decision of the Supreme Court,” Kask explained. 
The Estonian Greens submitted 9 candidates to the National Electoral Committee for the European Parliament elections on 9 June 2024; however, they only paid the security for the candidates Evelyn Sepp and Rasmus Lahtvee, and the Committee consequently decided not to register the other candidates with its decision on 29 April 2024. 


The party appealed to the Supreme Court, asking the European Parliament Election Act to be declared unconstitutional and the Committee to be obligated to register the unregistered candidates.


The Constitutional Review Chamber of the Supreme Court decided to ask for an advance ruling from the European Court of Justice and obligated the National Electoral Committee to register the candidates who met the other candidacy requirements as an interim measure despite the Estonian Greens not having paid the security in the amount set out in the law.


At its meeting today, the National Electoral Committee registered the following candidates of the Estonian Greens who had not been registered with the others: Alina Lerner-Vilu, Olev-Andres Tinn, Riin Ehin, Kaia Konsap, Liina Freivald, Tuula Raidna, Marko Kaasik. The candidates received registration numbers that followed the sequence after the last initially registered candidate. There are no grounds to change the registration numbers given to candidates who were registered earlier, and there is no need to redraw lots. 


The change in the list of candidates may affect the voters who live abroad and applied for voting by post by May 10 and have already been sent the election documents by foreign missions. Those who have already filled in their ballot paper and wish to change their vote should ask for a new ballot paper from the foreign mission. It is not possible to change a vote cast by ballot paper by voting again electronically. 
A total of 78 candidates run for the European Parliament elections on 9 June.
